1. About Us

Datumvista Research Ltd ("Datumvista", "we", "us", "our") is a market research company registered in England and Wales. We provide specialist research services including qualitative research, quantitative surveys, mystery shopping, brand tracking, retail mapping, and related intelligence services.

These Terms and Conditions apply to all visitors to our website at datumvista.com and to all clients who engage our services.

2. Use of This Website

By accessing and using this website, you agree to the following:

  • You will use the website only for lawful purposes and in a way that does not infringe the rights of others

Any proposal or quotation provided by Datumvista following an enquiry:

  • Is valid for 30 days from the date of issue unless otherwise stated
  • Is subject to change if the scope or requirements of the project change
  • Does not constitute a binding contract until a formal agreement or purchase order is signed by both parties

4. Engagement and Project Terms

When a project is formally commissioned, the following terms apply unless otherwise agreed in writing:

Project Scope

The scope of work, deliverables, timelines, and fees will be confirmed in a written proposal or Statement of Work (SOW). Any changes to the agreed scope must be requested in writing and may result in revised fees and timelines.

Payment Terms

  • A deposit of 50% of the agreed project fee is required before fieldwork commences, unless otherwise agreed in writing
  • The remaining balance is due upon delivery of the final report or agreed deliverable
  • Invoices are payable within 14 days of issue unless otherwise stated
  • Late payments may be subject to interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998

Project Cancellation

  • If a project is cancelled by the client after fieldwork has commenced, costs incurred up to the point of cancellation will be invoiced and remain payable
  • If a project is cancelled before fieldwork commences, the deposit may be partially or fully retained depending on costs already incurred in preparation
  • Datumvista reserves the right to suspend or terminate a project if payment obligations are not met

5. Confidentiality

Datumvista treats all client information, project briefs, data, and findings as strictly confidential. We will not disclose any client-specific information to third parties without prior written consent.

Where a formal Non-Disclosure Agreement (NDA) is signed between both parties, the terms of that NDA shall take precedence over this section.

Clients are equally expected to treat any proprietary methodologies, pricing, or unpublished research processes shared by Datumvista as confidential.

6. Intellectual Property

All content on this website — including text, design, graphics, logos, and layout — is the intellectual property of Datumvista Research Ltd and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, or republish any content from this website without our prior written permission.

Research Outputs

Upon receipt of full payment, the client receives a licence to use the research outputs (reports, data, findings) delivered by Datumvista for their internal business purposes.

  • Clients may not resell, sublicence, or commercially distribute research outputs without prior written agreement
  • Datumvista retains the right to reference the type and sector of work undertaken (without disclosing client identity) for business development purposes, unless otherwise agreed in writing
  • Raw data, fieldwork materials, and proprietary methodologies remain the intellectual property of Datumvista unless explicitly transferred in writing

7. Data Protection

Both Datumvista and its clients are responsible for ensuring that personal data collected during research projects is handled in accordance with applicable data protection laws, including the UK GDPR and Data Protection Act 2018.

Where Datumvista collects personal data on behalf of a client (for example, survey respondent data), Datumvista acts as a data processor and the client acts as the data controller. Both parties will agree appropriate data handling protocols before fieldwork commences.

8. Research Quality and Limitations

Datumvista will carry out all research projects with reasonable professional skill and care in accordance with industry standards.

Market research findings are based on data collected from samples at a specific point in time. They represent the opinions and behaviours of respondents at the time of the study and should not be interpreted as guaranteed predictions of future market behaviour or business outcomes.

Datumvista does not accept liability for business decisions made by clients based on research findings. The interpretation and application of research outputs remains the responsibility of the client.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Datumvista's total liability to any client for any claim arising from a project shall not exceed the total fees paid by the client for that specific project
  • Datumvista shall not be liable for any indirect, consequential, or special losses including loss of profit, loss of business, or loss of opportunity
  • Datumvista shall not be liable for any failure to perform its obligations where such failure is caused by circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, government restrictions, or technology failures

Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
